Please read these terms carefully. They describe the responsibilities of Rio Y Vida LLC and the customer for residential municipal and private well water filtration systems.

Scope of Work & Installation Fees

Customer Responsibility

The customer explicitly agrees that the comprehensive installation fee of $599.00 is a mandatory, separate, non-refundable charge for labor and site modification.

Site Readiness & Pre-Existing Plumbing

The customer guarantees that the property’s plumbing infrastructure is up to current local municipal codes prior to technician arrival. Rio Y Vida LLC is not responsible for delayed installations due to pre-existing code violations.

Financing, Credit Approvals & Interest

Financing Contingency

Equipment delivery and system deployment are strictly contingent upon third-party financial institution approval.

Credit Tier Disclosures

Approval tiers range from 620 to 850 points of credit score. The customer acknowledges that tier placements dictate fixed interest rates—where a 620 score represents the highest tier interest rate and an 850 score represents the lowest tier premium interest rate. All interest structures are set by the lender, not Rio Y Vida LLC.

Mandatory Biennial Maintenance Disclosure

Maintenance Interval

To preserve system integrity, the equipment requires mandatory preventative maintenance every two (2) years.

Operational Service Fee

Maintenance costs oscillate strictly between $250.00 and $399.00 depending on specific system filters, sanitization requirements, and resin replenishment needs.

Warranty Voidance

Failure to schedule and complete this required 2-year maintenance sequence with Rio Y Vida LLC or an authorized representative voids any and all underlying equipment operational warranties.

Specific Water-Source Liability Clauses

Subsection A: City (Municipal) Water Provisions

Fluctuations in Utility Treatment

System configurations are calibrated to local municipal water diagnostic readings on the exact date of sale. Rio Y Vida LLC is strictly not liable for subsequent operational anomalies caused by sudden changes in chemical treatments, over-chlorination, water main breaks, or line flushing executed by the city.

Internal Plumbing Contamination

The system purifies water at its structural point-of-entry. The company is not responsible for heavy metals (such as lead or copper) introduced to drinking water downstream due to unlined or decaying pre-existing residential internal copper or lead plumbing.

Pressure Limitations

Property water lines must maintain standard functional limits. If city-side lines spike or systematically exceed 80 PSI, the customer is responsible for installing a functioning Pressure Reducing Valve (PRV). Rio Y Vida LLC disclaims liability for pressure-induced leaks.

Subsection B: Private Well Water Provisions

Dynamic Aquifer Disclaimer

Underground water tables are volatile environments. Rio Y Vida LLC is strictly not liable for sudden underground water chemistry shifts, including unexpected spikes in arsenic, iron, sulfur, bacteria (E. coli), or heavy sediment caused by seasonal variations, construction, or aquifer drilling.

Pre-Filtration Requirements

If a private well exhibits contamination levels exceeding the maximum rated parameters of the primary Puronics unit, the customer agrees that supplemental pre-treatment hardware (e.g., spin-down sediment filters or UV sanitizers) must be added at an additional cost. Refusal to implement essential pre-filters voids all equipment performance guarantees.

Well Pump Operational Integrity

The customer guarantees the residential well pump and pressure tank are in optimal working condition. Rio Y Vida LLC is not liable for system backwash failures or structural low pressure caused by underpowered or failing well mechanics.

Limitation of Liability & Legal Remedies

Pre-Existing Conditions

Rio Y Vida LLC disclaims any liability for structural property damage or pre-existing household health conditions caused by municipal or well water prior to system commissioning.

Damage Cap

In the event of an operational system defect or installation-related leak, total maximum financial liability is legally capped at the exact total dollar value paid by the customer to Rio Y Vida LLC for the physical system hardware.

Consumer Right of Rescission (Cooling-Off Period)

Three-Day Right to Cancel

In accordance with Tri-State home solicitation laws (NY, NJ, PA), the consumer retains a strict 3-business-day right to cancel this contract without financial penalty. A signed, written “Notice of Cancellation” must be submitted before midnight of the third business day post-signing.
